Official Rules for the Artists Against Anxiety Contest

  1. Eligibility: The Artists Against Anxiety Contest (the “Contest”) is open to legal residents of the United States who submit an entry via the webform here. Participants must be 18 years of age or older as of their date of entry in this promotion in order to qualify. This Contest is subject to federal, state, and local laws and regulations and void where prohibited by law. No purchase necessary. Purchase does not enhance the chance of winning. ThunderShirt, LLC's employees, its subsidiaries, affiliates, suppliers, partners, advertising and promotion agencies, and directors (collectively the “Employees”), as well as members of an Employees' immediate family and/or those living in the same household of Employees are ineligible to participate in the Contest.

 

  1. Sponsorship: The sponsor of the Contest is ThunderShirt, LLC (“Sponsor”), located at 112A Broadway St, Durham, NC 27701. Sponsor will conduct the Contest substantially as described in these Official Rules.

 

  1. Agreement to Rules: By entering the Contest, the participant (“You”, “Your” or “Participant”) agrees to abide by the Sponsor's Official Rules and decisions, which are fully and unconditionally binding in all respects. Sponsor reserves the right to refuse, withdraw or disqualify any entry at any time at Sponsor’s sole discretion. By entering the Contest, You represent and warrant that You are eligible to participate based on eligibility requirements explained in these Official Rules. You also agree to accept the decisions of the Sponsor as final and binding as it relates to the content of the Contest.

 

  1. Contest Entry Period: The Contest will begin on April 2, 2020 at 12:01 AM EST and ends on May 12, 2020 at 11:59 PM EST (“Entry Period”). Entries must be received by Tuesday at 11:59 PM EST of each week to be eligible for the Prizes to be awarded on Friday of the same week. To be eligible for the Contest, entries must be received within the specified Entry Period.

 

  1. How to Enter: Eligible Participants can enter the Contest by submitting an entry to via the webform here. As a Participant, your entry must fully meet all Contest requirements, as specified in the Official Rules to be eligible to win a Prize. Incomplete entries or those that do not adhere to the Official Rules or specifications will be disqualified, at Sponsor's sole discretion.

 

 Additional entry details:

  • Entries can consist of short videos, illustrations and other visual arts, photographs, sculptures, essays - or any other type of original art form.
  • All entries must be original work and not violate anyone’s proprietary or intellectual property rights.
  • Entries should highlight and bring awareness to pet anxiety issues.
  • Entries should not address political issues, political viewpoints or other potentially divisive issues.
  • Entries should not address anxiety related to Covid-19 issues.

Fraudulent methods of entry or circumvention of the Official Rules may result in the Sponsor invalidating such entries and removing them from the Contest, at the Sponsor’s sole discretion.

 

  1. Prizes: A total of twenty-five (25) prizes will be awarded. Each prize consists of one-thousand dollars ($1,000) (the “Prize”). Prizes will be selected based on originality, creativity, humor, relevant content, clarity of expression and emotional impact of the entry. Prizes will be paid in the form of a $1,000 check payable to the winner(s) (each a “Winner”) within one week of winner selection each week (assuming all required information is provided by the winner).  Prizes are limited to one per Participant for the Contest.  There shall be no Prize substitutions permitted, except at Sponsor’s discretion. The Prize is non-transferable. The Winner(s), upon acceptance of the Prize, is solely responsible for all expenses related to the Prize, including without limitation any and all local, state, and federal taxes. The Winner(s) shall not transfer assignment of the Prize to others nor shall the Winner(s) request the cash equivalent or prize substitution. By accepting the Prize, the selected Winner(s) grants permission for the Sponsor to use the Winner(s)’s likeness, entry, and name for purposes of advertising and trade without further compensation unless prohibited by law.  The Winner(s) must provide Sponsor with a valid Social Security number or taxpayer-identification number before Sponsor can award the Prize to such Winner. A form 1099 will be issued to the Winner(s) for tax purposes.

 

  1. Odds: The total number of eligible entries received impacts the odds of winning in addition to the selection criteria.

 

  1. Selection and Notification of Winner(s): The Winner(s) will be selected by a panel of judges, to be chosen by Sponsor at Sponsor’s sole discretion. Once you've submitted your entry, You are automatically entered for all remaining weeks of the Contest, unless you win.  Each Participant is eligible to win only one Prize for the duration of the Contest. Judging will begin on Wednesday, April 15th and then continue for the next four Wednesdays.  All submissions will be judged based on multiple criteria. Does it make us laugh? Does it make us feel? Does it make us more aware of pet anxiety in some way? How original or creative is it?  These questions and others will apply.   A total of 25 winners will be selected and up to five (5) winners will be announced by 1 pm EST every Friday after the start on April 15th. All winners will be notified by email and announced on our Facebook page. Sponsor is not responsible for, nor shall have no liability for, Winner(s)’s failure to receive notices due to email security settings that may cause notifications to be marked as spam or junk email. Nor shall Sponsor be liable for the Winner(s)’s provision of incorrect or otherwise non-functioning contact information. If the Winner(s) 1) fails to claim the prize within 20 days from the time the award notification was sent, 2) is found ineligible, or 3) does not complete and return an executed declaration and release within the specified timeframe, the Prize will be forfeited and alternate Winner(s) may be selected. Receipt of the Prize (offered in the Contest) by the Winner(s) is upon the condition of compliance with any and all federal, state, and local laws and regulations. IF THE WINNER(S) VIOLATES ANY OF THESE OFFICIAL RULES, THE WINNER(S) (AT THE SPONSOR’S SOLE DISCRETION) WILL BE DISQUALIFIED, AND ALL PRIVILEGES AS WINNER(S) WILL BE IMMEDIATELY TERMINATED.

 

  1. Rights Granted by You: By submitting an entry (e.g., text, video, photo, etc.) into this Contest, You understand and agree that Sponsor, any individual acting on Sponsor’s behalf, and the licensees successors, and assigns of Sponsor shall, where permitted by law, have the right to print, publish, broadcast, distribute and use in any media, during the duration of the Contest and for a period of eight weeks thereafter, without limitation, your submission for the purposes of promoting the Contest without any further notice, review, consent, compensation, or remuneration. All entries must be original work and not violate anyone’s proprietary or intellectual property rights. The consequences for entries that infringe upon the intellectual property rights of others include disqualification of the Participant and any claims that arise as a result of infringement.  You shall defend or settle against such claims at your sole expense, and You shall indemnify, defend and hold harmless Sponsor from any suit, etc.  Further, if You are a Winner, You understand and agree that Sponsor, any individual acting on Sponsor’s behalf, and the licensees successors, and assigns of Sponsor shall, where permitted by law, have the right to print, publish, broadcast, distribute and use in any media known now or hereafter developed, in perpetuity, worldwide, and without limitation, your submission and your biographical information for news, publicity, advertising, promotional purposes, trade, information, and public relations without any further notice, review, consent, compensation, or remuneration. Sponsor shall also have the perpetual, fully-paid right to modify, derive from, repurpose, or otherwise alter the entry, and to print, publish, broadcast, distribute and use the entry in any media known now or hereafter developed, worldwide, with or without attribution to You.

 

  1. Terms & Conditions: In its sole discretion, Sponsor reserves the right to modify, suspend, cancel or terminate the Contest should non-authorized human intervention, a bug or virus, fraud or other causes beyond Sponsor’s control, impact or corrupt the security, fairness, proper conduct or administration of the Contest. Sponsor, in the event of any of the above issues, may determine the Winner(s) based on all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Individuals who tamper with or attempt to tamper with the operation or entry process of the Contest or website or violates these Official Rules will be disqualified by Sponsor in its sole discretion. In its sole discretion, Sponsor has the right to maintain the integrity of the Contest and to void votes for any reason.  Attempts by any Participant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. If any such attempt is made, Sponsor reserves the right to seek damages to the fullest extent permitted by law.

 

  1. Limitation of Liability: Your entry into this Contest constitutes Your agreement to release and hold harmless the Sponsor and its subsidiaries, representatives, affiliates, partners, advertising and promotion agencies, successors, agents, assigns, directors, employees, and officers against and from any and all claims, liability, illness, injury, death, litigation, loss, or damages that may occur, directly or indirectly from participation in the Contest and/or the 1) Winner(s) accepting, possessing, using, or misusing of any awarded prize or any portion thereof; 2) any type of technical failure; 3) the unavailability or inaccessibility of any transmissions, phone, or Internet service; 4) unauthorized intervention in any part of the entry process or the Contest; 5) electronic error or human error in the Contest administration or the processing of entries.

 

  1. Disputes: THIS CONTEST IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND THE STATE OF NORTH CAROLINA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. Participant agrees, as a condition of participating in the Contest, that if any disputes cannot be resolved between Participant and Sponsor, and if causes of action arise out of or are connected with the Contest, they shall be individually resolved exclusively before a court located in North Carolina having jurisdiction, without resorting to any form of class action. Under no circumstances in any such dispute shall Participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than Participant’s actual out-of-pocket expenses (i.e. costs associated with entering the Contest). Participant waives all rights to have damages multiplied or increased.

  1. Winners List: You may obtain a copy of the Winner(s)’s name(s) or a copy of the Official Rules, by sending your request via mail with a stamped, self-addressed envelope to: ThunderShirt LLC, 112A Broadway St, Durham, NC 27701. Requests must be postmarked no later than 05/31/2020.

 

  1. Social Media Channel-Specific Rules: The Artists Against Anxiety Contest hosted by ThunderShirt, LLC is in no way sponsored, endorsed, administered by or associated with Facebook, Instagram or Twitter.

 

  1. By submitting Your Contest entry, You, have affirmatively reviewed, accepted, and agreed to all of the Official Rules.
